Si el Cliente selecciona a un Empleado de FRGS para una Cesi\u00f3n, las Partes completar\u00e1n y ejecutar\u00e1n una <a href=\"https:\/\/stage.tenthrevolution.com\/es\/legal\/calendario-de-asignaciones-de-los-empleados-de-frgs\/\"><u>Horario de asignaci\u00f3n de los empleados de FRGS<\/u><\/a>. Mediante la firma de un Programa de Asignaci\u00f3n de Empleados de FRGS, el Cliente acepta los presentes T\u00e9rminos y Condiciones de los Empleados de FRGS y la <a href=\"https:\/\/stage.tenthrevolution.com\/es\/legal\/politica-de-gastos-de-los-empleados-de-frgs\/\"><u>Pol\u00edtica de gastos de los empleados de FRGS<\/u><\/a>, vinculado al presente documento e incorporado al mismo por la presente referencia<strong>. <\/strong><\/p><p>FRGS firmar\u00e1 acuerdos de empleo por escrito con cada empleado de FRGS; confirmar\u00e1 la capacidad del empleado de FRGS para trabajar en Estados Unidos; ofrecer\u00e1 a cada empleado de FRGS elegible beneficios m\u00e9dicos y de otro tipo, incluyendo, sin limitaci\u00f3n, licencia por enfermedad remunerada y no remunerada y licencia parental remunerada y no remunerada, seg\u00fan lo exija la legislaci\u00f3n aplicable; pagar\u00e1 a cada empleado de FRGS de conformidad con la legislaci\u00f3n aplicable; retendr\u00e1 y transmitir\u00e1 los impuestos sobre la n\u00f3mina a las autoridades gubernamentales correspondientes; proporcionar\u00e1 compensaci\u00f3n a los trabajadores y otros seguros relacionados con el empleo seg\u00fan lo exija la legislaci\u00f3n aplicable; realizar\u00e1 contribuciones por desempleo en nombre de cada empleado de FRGS; y gestionar\u00e1 las reclamaciones por desempleo y compensaci\u00f3n a los trabajadores que involucren a un empleado de FRGS.<\/p><p>Por la presente, el Cliente consiente y acepta que FRG apruebe autom\u00e1ticamente todas las hojas de horas presentadas por un Empleado de FRGS, a menos que el Cliente notifique a FRG la existencia de una Disputa en el plazo de cinco (5) d\u00edas h\u00e1biles desde la presentaci\u00f3n de dicha hoja de horas, y que dicha aprobaci\u00f3n autom\u00e1tica sea vinculante para el Cliente a todos los efectos.<\/p><p><strong>La obligaci\u00f3n del Cliente de indemnizar en virtud de las Condiciones Generales se aplicar\u00e1 igualmente a FRGS, en su caso, salvo en la medida en que la Reclamaci\u00f3n se derive de cualquier acto u omisi\u00f3n de FRGS.<\/strong><\/p><p><strong>No obstante cualquier disposici\u00f3n en contrario en este documento, y en la m\u00e1xima medida permitida por la ley, FRG, en nombre de FRGS, por la presente renuncia a todas las garant\u00edas y representaciones con respecto a los Servicios de Tiempo y Materiales, incluyendo, sin limitaci\u00f3n, cualquier garant\u00eda de comerciabilidad, idoneidad para un prop\u00f3sito particular, puntualidad, integridad o la consecuci\u00f3n de cualquier entregable particular, resultado, funcionalidad o capacidad.<\/strong><\/p><p><strong>Excepto en la medida directamente atribuible a la negligencia grave, dolo o fraude de FRGS, FRGS no acepta ni tiene ninguna responsabilidad por cualquier p\u00e9rdida, gasto, da\u00f1o, juicio, costo o retraso que surja de un Informe de Antecedentes o de los actos, omisiones, negligencia, deshonestidad, mala conducta o incapacidad de un Contratista o si un Contratista no proporciona, por cualquier raz\u00f3n, Servicios de Tiempo y Materiales para toda la duraci\u00f3n del Programa de Asignaci\u00f3n.<\/strong><\/p><p><strong>No obstante cualquier disposici\u00f3n en contrario contenida en el presente documento, y en la m\u00e1xima medida permitida por la ley, (a) la responsabilidad total de FRGS, en su conjunto, se limitar\u00e1 a los importes efectivamente pagados por el Cliente a FRG en virtud del presente documento durante el per\u00edodo de seis (6) meses inmediatamente anterior a la ocurrencia del conjunto de hechos y circunstancias que dieron lugar por primera vez a la(s) reclamaci\u00f3n(es) en la(s) que se basa dicha responsabilidad y (b) bajo ninguna circunstancia FRGS ser\u00e1 responsable ante el Cliente o el Cliente del Cliente por cualquier da\u00f1o indirecto, da\u00f1os punitivos, especiales, ejemplares o consecuentes, incluso si FRGS sab\u00eda o deber\u00eda haber sabido, o ha sido advertido de la posibilidad de tales da\u00f1os o si tales da\u00f1os eran previsibles. <\/strong><\/p><p><strong>\u00a0<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>FRGS Employee Terms and Conditions Last Modified: April 5, 2022 Unless otherwise defined hereunder, all capitalized terms used herein shall have the meanings ascribed to them in the Standard Terms and Conditions or Order Form.
