Si le client s\u00e9lectionne un employ\u00e9 de l'ERSG pour une mission, les parties doivent remplir et signer un formulaire de demande d'affectation de l'employ\u00e9 de l'ERSG. <a href=\"https:\/\/stage.tenthrevolution.com\/fr\/juridique\/calendrier-daffectation-des-employes-de-frgs\/\"><u>Calendrier d'affectation des employ\u00e9s de l'ERSG<\/u><\/a>. En signant le programme d'affectation d'un employ\u00e9 de l'ERSF, le client accepte par la pr\u00e9sente les pr\u00e9sentes conditions g\u00e9n\u00e9rales de l'employ\u00e9 de l'ERSF et les conditions g\u00e9n\u00e9rales de l'ERSF. <a href=\"https:\/\/stage.tenthrevolution.com\/fr\/juridique\/politique-de-depenses-des-employes-de-frgs\/\"><u>Politique de d\u00e9penses des employ\u00e9s de l'ERSG<\/u><\/a>, li\u00e9e \u00e0 la pr\u00e9sente et incorpor\u00e9e dans le pr\u00e9sent document par la pr\u00e9sente r\u00e9f\u00e9rence<strong>. <\/strong><\/p><p>FRGS conclura des contrats de travail \u00e9crits avec chaque employ\u00e9 de FRGS ; confirmera la capacit\u00e9 de l'employ\u00e9 de FRGS \u00e0 travailler aux \u00c9tats-Unis ; offrira \u00e0 chaque employ\u00e9 de FRGS \u00e9ligible des prestations m\u00e9dicales et autres, y compris, mais sans s'y limiter, des cong\u00e9s de maladie pay\u00e9s et non pay\u00e9s et des cong\u00e9s parentaux pay\u00e9s et non pay\u00e9s, conform\u00e9ment \u00e0 la l\u00e9gislation applicable ; paiera chaque employ\u00e9 de FRGS conform\u00e9ment \u00e0 la l\u00e9gislation applicable ; retiendra et transmettra les imp\u00f4ts sur les salaires aux autorit\u00e9s gouvernementales appropri\u00e9es ; fournira une assurance contre les accidents du travail et d'autres assurances li\u00e9es \u00e0 l'emploi conform\u00e9ment \u00e0 la l\u00e9gislation applicable ; versera des cotisations de ch\u00f4mage au nom de chaque employ\u00e9 de FRGS ; et g\u00e9rera les demandes d'indemnisation du ch\u00f4mage et des accidents du travail impliquant un employ\u00e9 de FRGS.<\/p><p>Le client consent par les pr\u00e9sentes \u00e0 ce que FRG approuve automatiquement toutes les feuilles de temps soumises par un employ\u00e9 de FRGS, \u00e0 moins que le client ne notifie \u00e0 FRG un litige dans les cinq (5) jours ouvrables suivant la soumission d'une telle feuille de temps, et cette approbation automatique est contraignante pour le client \u00e0 toutes fins utiles.<\/p><p><strong>L'obligation d'indemnisation du client en vertu des conditions g\u00e9n\u00e9rales s'applique \u00e9galement au FRGS, le cas \u00e9ch\u00e9ant, sauf dans la mesure o\u00f9 la r\u00e9clamation d\u00e9coule d'un acte ou d'une omission du FRGS.<\/strong><\/p><p><strong>Nonobstant toute disposition contraire dans les pr\u00e9sentes, et dans toute la mesure permise par la loi, FRG, au nom de FRGS, d\u00e9cline par les pr\u00e9sentes toutes les garanties et repr\u00e9sentations relatives aux services de r\u00e9gie, y compris, sans limitation, toute garantie de qualit\u00e9 marchande, d'ad\u00e9quation \u00e0 un usage particulier, d'opportunit\u00e9, d'exhaustivit\u00e9 ou de r\u00e9alisation d'un produit livrable, d'un r\u00e9sultat, d'une fonctionnalit\u00e9 ou d'une capacit\u00e9 particuliers.<\/strong><\/p><p><strong>Sauf dans la mesure o\u00f9 cela est directement imputable \u00e0 la n\u00e9gligence grave, \u00e0 la faute intentionnelle ou \u00e0 la fraude de FRGS, FRGS n'accepte ni n'a aucune responsabilit\u00e9 pour toute perte, d\u00e9pense, dommage, jugement, co\u00fbt ou retard r\u00e9sultant d'un rapport d'ant\u00e9c\u00e9dents ou des actes, omissions, n\u00e9gligence, malhonn\u00eatet\u00e9, faute ou incapacit\u00e9 d'un contractant ou si un contractant ne parvient pas, pour quelque raison que ce soit, \u00e0 fournir des services en temps et en heure pendant toute la dur\u00e9e du calendrier d'ex\u00e9cution de la mission.<\/strong><\/p><p><strong>Nonobstant toute disposition contraire dans les pr\u00e9sentes, et dans toute la mesure permise par la loi, (a) la responsabilit\u00e9 totale de FRGS, dans l'ensemble, sera limit\u00e9e aux montants effectivement pay\u00e9s par le Client \u00e0 FRG en vertu des pr\u00e9sentes au cours de la p\u00e9riode de six (6) mois pr\u00e9c\u00e9dant imm\u00e9diatement la survenance de l'ensemble des faits et circonstances donnant lieu \u00e0 la (aux) r\u00e9clamation(s) sur laquelle (lesquelles) cette responsabilit\u00e9 est fond\u00e9e et (b) en aucun cas FRGS ne sera responsable envers le Client ou le Client du Client pour tout dommage indirect, punitif, sp\u00e9cial, exemplaire ou cons\u00e9cutif, m\u00eame si FRGS savait ou aurait d\u00fb savoir que de tels dommages \u00e9taient possibles ou si de tels dommages \u00e9taient pr\u00e9visibles, dommages indirects, punitifs, sp\u00e9ciaux, exemplaires ou cons\u00e9cutifs, m\u00eame si FRGS savait ou aurait d\u00fb savoir, ou a \u00e9t\u00e9 inform\u00e9 de la possibilit\u00e9 de tels dommages ou si de tels dommages \u00e9taient pr\u00e9visibles. <\/strong><\/p><p><strong>\u00a0<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>FRGS Employee Terms and Conditions Last Modified: April 5, 2022 Unless otherwise defined hereunder, all capitalized terms used herein shall have the meanings ascribed to them in the Standard Terms and Conditions or Order Form.
